LVNV Funding & Resurgent: What to Do If They Contact You

Seeing LVNV Funding on your credit report, or letters from Resurgent Capital Services? Here is how these companies work and what you can do.

Who Is LVNV Funding?

LVNV Funding LLC is a debt buyer. It purchases past-due consumer accounts (often credit cards) from original lenders. LVNV typically does not collect directly: its accounts are usually managed by Resurgent Capital Services, which may then assign them to other collection agencies or law firms.

That is why you might see LVNV Funding on your credit report but receive letters from a different collection agency. Ask who owns the debt and who is collecting it.

First Steps When LVNV Funding Contacts You

  1. Don’t ignore it, and don’t panic. Write down the date, the name of the person you spoke with, and the account number they reference.
  2. Don’t agree to pay or confirm the debt on the first call. You have the right to see proof first.
  3. Request debt validation in writing within 30 days of their first notice. Ask for the original creditor, the amount, and how they calculated it. How debt validation works.
  4. Check all three credit reports at AnnualCreditReport.com and compare the balance, dates and account details. Dispute anything inaccurate.
  5. Check the age of the debt. In California, the time limit to sue on most written contracts is generally four years. Making a payment can sometimes affect your rights, so get advice first. Time-barred debt explained.
  6. Keep everything in writing and save copies of every letter you send and receive.

Your Rights

Federal law (FDCPA)

Collectors must send a validation notice, may not use false or misleading statements, and may not harass you. You can ask them in writing to stop contacting you. Learn more

California law

The Rosenthal Act extends collection protections in California, and the California Fair Debt Buying Practices Act requires debt buyers to have certain account documents and gives you the right to request them.

Credit reporting (FCRA)

Information on your credit reports must be accurate and complete. You can dispute errors with each credit bureau for free.

Can I Settle With LVNV Funding?

Because LVNV bought the account at a discount, settlements and payment plans are often possible. Make sure you are dealing with the company actually authorized to collect before you pay.

  • Get any settlement offer in writing before you pay.
  • Ask how the account will be reported afterward. “Settled for less than the full balance” can still affect your credit.
  • Some companies may agree to stop reporting an account after payment, but many won’t, and you should never count on it.
  • Forgiven debt of $600 or more may be reported to the IRS on a 1099-C.
  • Keep proof of every payment and the final “paid” or “settled” letter.
Were you served with court papers? In California you generally have 30 days to file a written response. If you miss it, the court can enter a default judgment, which can lead to wage garnishment or a bank levy. What to do if you’re sued
